If some chemical genuinely is not psychoactive by any realistic definition and the police tried to convict someone of sale or whatever, they wouldn't be able to secure a conviction in court. The court would need to be satisfied that the chemical in question is genuinely psychoactive (satisfying their understanding of the word psychoactive). So they can't ban ANY chemical like you're claiming
