The case is an example of how the Supreme Court is theatre, and the federal government does what they can get away with regardless of how the individual judges are supposed to perform based on the pedigree that was paraded before the public prior to their nomination.

Scalia created a legal precedent in the 1970's as a federal judge, Auer principle, which dramatically expanded the power of the federal government.

Then 20 years later, he's on the supreme court now, playing the "arch conservative", and he argues against his own principle, but not surprisingly, he's outvoted, and Auer principle is sustained.

Then another 20 years pass, Scalia is dead, and the sole remaining "arch conservative" cites the dead guy's argument against his own precedent, but is again btfo.

So from what I can gather, this is all about the "Auer principle" which basically says, where a government agency is legislatively granted the right to regulate something, that agency is the arbiter of precisely what the regulations it makes, means, should there be ambiguity, in the absence of any other indications in the relevant legislation.

This kinda makes sense. The ones writing the regulations know what they mean, and if Congress disagrees, it can amend the relevant legislation granting the right to regulate to the agency. Either to provide more direction, specifically override the regulation, or define interpretation as falling under the court's purview.

What's the problem with this arrangement?

Seriously though, the courts still can get involved where there's a conflict of a regulation with other law, or where congress directs that the courts determine ambiguities.

The principle only applies to situations where there are multiple possible perfectly legal interpretations of a regulation.

The problem is that the regulatory agencies have been given UNLIMITED right to not just regulate but effectively legislate which goes beyond the intention of the agency as well as the law itself - many agencies violate the constitution, for example due process rights, willfully and without rebuke.

While it is possible for the legislature to remove the right, that requires political willpower that is nonexistent, and doesn't solve the issue that agencies will overreach over now meaningless boundaries, especially given that the Supreme Court has signaled that it is unwilling to interfere where the agencies transgress the law and the constitutional boundaries of the country's governance.

This is incredibly dangerous as, while sure, many situations are perfectly legal, the transformation of agencies from regulative to de facto legislative bodies blurs major boundaries between the separation of power of Legislature, Executive and Judiciary, as the Executive assumes the power of the others.

This is bad.
Why?
Well, why should the executive keep the others if it can do their job, protections be damned?
