You remember that crazy voting in the brazilian parliament to depose Dilma, right? Dilma striked back. The STF (Supreme Court) bought by PT suspended Cunha (president of the parliament who started the impeachment process) and his replacement, Waldir Maranhão, CANCELLED the entire impeachment process and asked the documents back from the senate (which was a week from taking Dilma from power definitely). The whole order was made by AGU, a group of lawyers also hired by the government.

The reasons for the cancelling are ridiculous. Waldir says it is because it was unconstitutional to publicly declare your vote BEFORE the voting day. Also, the impeachment should've been a resolution, not a voting.

Wrath walks the streets of Brazil today. People might invade the parliament this night.

It is happening. Pray for Brazil, /pol/.

The commies are striking back.

That is only true to a certain extend. What if something other than monarchy that is better for the country comes along? what if something is good for the country but bad for the monarchy? will he support it? i think not. Also you are counting on the fact that all kings will be reasonable, intelligent men. History shows that this is not the case.

Problem here is that you can't remove that exception except by force.
That causes instability and potential bloodshed.
Meanwhile in a democracy you can simply impeach a leader in a democratic process.
>I would need an example of something that is good for the country but bad for the monarchy though
Monarch could just be mad, or make a wrong decision more often. And he suffers no repercussion for that.
Not to mention monarchy implies hereditary transfer of power and that's totally retarded. Why the fuck would someone gain power automatically simply because he crawled out of the right vagina?

>I would need an example of something that is good for the country but bad for the monarchy though
I'll admit it is a bit difficult without dwelling in science fiction (like tech so advanced that makes the monarch obsolete, like perfect genetic manipulation, super IA computers and so on). What is much easier is to think about something good for the monarch but bad for the people (and thats what monarchs always tend to do): New taxes, stronger military and jingoism, invasion of other countries at the expense of the people's lifes, a succession dispute between to heirs to the throne, having to house the king's soldiers in your own house, and so on. they are literally endless.
>bad apples, I think you'll find they are the exception
Well being intimately familiar with spanish history, i'd say thats completely false. The bad apples are the rule. In fact i can't think of a single king of spain that was at least kinda good. They were all absolutely terrible. The best ones are the current king and his father, just because they can't do jack shit and hold no power and just go buy prostitutes.

yeah, that only works in countries that stick to the principles of democracy. none do, especially ones that went with the corrupt "social democracy" aka socialism, like most of the democratic countries in the world.
>>
>>73508189
>you can impeach in a democracy
Are you in the same thread as me? Napoleon III was elected as president, didn't stop him from becoming emperor.
The repercussions of a bad decision affect the monarch directly, house is that not significant?
Also, no. Monarchy does not imply hereditary rulers. Personally I have my doubts but hereditary has it's advantages: Additional motivation for the ruler to do good for the benefit of his heir, the child is raised and educated to become a ruler
I'm trying to think of a better selection system but I can hardly think of any
>>
>>73508698
And enlightened monarchy only works if monarch is enlightened and competent.
Once again, it turns out democracy is simply the least bad system.
>>
>>73508901

>gave us two World Wars.
>Yes, that's all they gave us. And great conflicts never happened in past. Like Seven Years' War.
Fair enough. Doesn't put democracy in a better light though
>>
>>73508849
>The repercussions of a bad decision affect the monarch directly
No they don't. It takes a lot of mistakes which cost a lot for people to get riled up enough to remove monarch. And removal of monarchy is a chaotic process which can cause a huge disruption.
>Napoleon III was elected as president
Napoleon III was a glorified dictator. Who committed shitload of mistakes.
>but hereditary has it's advantages
It's simply unfair. Someone becomes the most powerful man in the country simply by pure chance.
>the child is raised and educated to become a ruler
Are you seriously implying that there is such a process that guarantees success in education?
Show me that process and I'll concede.
>I'm trying to think of a better selection system
Democratic elections.
In the end, people are responsible for their own failures. That's a lot better than people suffering for no reason but idiotic decisions of a man who gained power by virtue of being a son or daughter of a ruler.
And additionally, dude, no one takes monarchies seriously today. Only way monarchy could survive is if you brainwashed population into it for decades. Which is a horrifying proposition.
In past where monarchies existed, there were many factors that allowed them to exist. First, population was mostly illiterate and highly uneducated. Proposition of some family being ordained by God to rule over them made sense. Today it makes none.
>>
>>73509473
>the post industrial revolution world that spawned and thrived under monarchies?
Where?
Only in Germany, which was a peculiar monarchy.
>At this point I know you're trying
What?
>Meritocratic administration
Or whoever is strong to kill opponents takes power. That does not make a successful civilization.
>incredibly secure territory
It collapsed pretty quickly.
>thriving trade
That's the accidental benefit I mentioned. In all empires of all sorts trade thrives. It's natural.
>>
>>73508533
Regarding your first point. I think having a condition is the beginning of a solution. Hard to enforce though.
My father was born Spanish but I'm more familiar with French history which is far from unambiguously bad. We would need a very wide study but I think the longevity of a lot of monarchies speaks for itself.
>>
The role of a monarch in a parliamentary monarchy is pretty much the same as the president in a parliamentary republic. They can open and dissolve the parliament and form the government (ie choose which party has the right to define the prime minister) depending on which party or coalition holds the majority.

At least that's what Portugal's president do, which is the parliamentary republic I'm familiar with.
>>
>>73509482
>In the end, people are responsible for their own failures.
right now it's more like majority of people is hurt by minority's extreme fuck ups, who are responsible for the problem in the first place.

this is the exact opposite of democracy. vocal minority controls the elections and makes the country unlivable for the majority, who is too afraid to push back because they're deceived into thinking they're alone.

The exact same flaws are showing in modern democracies, but they're even more impossible to overcome than replacing a single dictator. The entire ruling class is cemented in and bribed. People who don't play ball don't get money and don't get advertisement or party support. Only party members get elected. No actual skills or knowledge required, full of career bureaucrats and desk jockeys.

Guess what, today's populations are just as uneducated regarding modern economic and political issues. Congress is repeatedly reelected despite rock bottom approval. The worst part is, most of them don't care about the nation at all, since their money is coming from internationals, and they can always fuck off somewhere else if the riots start.
And the only way it will change is when blood is spilled. Because frankly, violence is the best encouragement for leaders of any stripe not to fuck up.

So Maranhão was vice-president of the lower house and also pro-Dilma, who replaced the anti-Dilma president Cunha after Cunha was forced to step down to face corruption charges. Maranhão got a request from the pro-Dilma attorney general, Cardozo, to annul the impeachment motion in the lower house using the excuse of "procedural flaws." Maranhão accepted the request and now the lower house vote has been invalidated before it enters the upper house for a vote. The president of the upper house, Calheiros, ignored the annulment and said the upper house will vote on the impeachment anyways.

Questions:

If the impeachment motion is approved by the upper house, is it still legally binding considering the motion was annulled in the lower house? Or is the upper house vote only valid if the lower house's previous vote was valid at the time the upper house vote took place?

Can the motion move to the Supreme Court without the votes of both houses being legitimate?

Can what happened in the lower house with Cunha and Maranhão happen in the upper house as well with Calheiros and a Dilma supporter?

Also, what is the likelihood of the Supreme Court overturning Cardozo's and Maranhão's annulment? If the impeachment does reach the Supreme Court, is it likely that the Court will vote to impeach Dilma?
>>
>>73521794
Yes. No

The Commons house does not judge, only accept the process - they do not matter anymore.

Hardly. Nada acontece, feijoada.

>If the impeachment motion is approved by the upper house, is it still legally binding considering the motion was annulled in the lower house? Or is the upper house vote only valid if the lower house's previous vote was valid at the time the upper house vote took place?

We need the lower to get it to the upper, what can happen is the upper house ignoring what Maranhão said.

>Can the motion move to the Supreme Court without the votes of both houses being legitimate?

In theory it shouldn't, but the anti-dilma wnig will push it anyways to the Supreme Court, so they can decide if Maranhão's action is legitimate.

>Can what happened in the lower house with Cunha and Maranhão happen in the upper house as well with Calheiros and a Dilma supporter?

I don't think so, Caiado is a small fish on the corruption world, he alredy faced minor stuff and stopped to fuck with public money
>>

>>
>>73521794
>If the impeachment motion is approved by the upper house, is it still legally binding considering the motion was annulled in the lower house?
It needs both, but with over 2/3 of the congress being in favor, one person alone can't change much.

>Can the motion move to the Supreme Court without the votes of both houses being legitimate?
Both houses are legitimate, but it will always go to the supreme court.

>Can what happened in the lower house with Cunha and Maranhão happen in the upper house as well with Calheiros and a Dilma supporter?
Maranhão doesn't have support in the congress like Cunha, so it wouldn't be needed. It's unlikely the supreme court would remove him.

>Also, what is the likelihood of the Supreme Court overturning Cardozo's and Maranhão's annulment?
It will end there regardless of senate decision (and the president of the senate chose to ignore it), and I'd say it's likely that they'd overturn it. The Court policy has been of not interference so far beyond establishing the rite.

I don't think that many countries would actually riot or do a coup these days. Brazil is not that great but it has some level of development. If you had to choose between staying in your comfy apartment while browsing the Internet and yelling in there OR actually go outside and risk yourself getting harmed, a lot of people would choose the first option.

Guess what was the REAL turning point in Egypt few years ago? They cut off the Internet. If you want to keep people doing nothing while they think they are making a difference then keep them in the Internet. This is what the developed countries are moving towards. We simply do not care enough or we think that our virtual actions have some real effect on the world. I hope Brazil proves me wrong and beheads that bitch and all her lackeys.

The annulment by the acting President of the lower house was null and void because 1) there is no legal or regimental provision for monocratic annulment of Impeachment. Necessarily, an annulment would need to pass by the Plenary, which was the one who approved the procedure; and 2) The act is lapsed; necessarily would have to be appreciated in the course of the proceedings in the lower house.

>>73522776
It can not be annulled (individually) by the President of the lower house, neither after following to the Senate.

Therefore is being ignored. Because it is null. What is null has no effect; does not exist juridically.
>>
