- La Cassazione con una sentenza depositata il 29 ottobre 2014 ha dichiarato che il reato non è stato ancora abolito e che c'era un vuoto normativo.

- Sempre le forze di polizia già nel 2008 denunciavano che: "Prevedere l'arresto obbligatorio in flagranza ed il processo per direttissima, implica che gli stranieri vadano presi e accompagnati non in carcere ma presso le strutture di polizia e tenuti in custodia fino al giorno dopo quando ci sarà il processo. Ciò comporta che le pattuglie dovranno abbandonare il territorio per sorvegliare i fermati: ci sarà quindi meno sicurezza. Ancora più grave l'articolo che allunga i tempi di detenzione nei CIE. La norma aggraverà il sovraffollamento delle carceri e determinerà un aumento esponenziale dei processi".
