4-4 splits make neither precedent nor federal standards, they essentially make it so the Supreme Court pretends it never got the case. Since states do not have the power to deport individuals (only federal organizations do), the 5th District's ruling which the split sustained really only applies to the immigrants' status in Texas Law. In particular it says that Texas, who made laws that required giving services (particularly drivers licenses) to all residents not eligible for deportation, do not have to honor those laws with regard to immigrants covered under DAPPA because the 5th District itself does not recognize DAPPA as constitutional. But with respect to all other districts and the nation as a whole, it still holds. So basically all it amounts to is that illegals in Texas can't get drivers licenses.

Affirmative action would have been tied so it would revert to the lower court which would have led to the same thing. It actually changed nothing since aa as the law and was upheld. The only thing that it changes is the wording in the majority descision which opens up further lawsuits to enforce mandatory aa.

I've had good moments and bad moments with them over the years. Most of the bad moments were in my teen years when I was the average black teen, still I get a little mad when I get pulled not because of the cop, mainly because I'm going to be out $200 soon.
