Classified information doesn't have to be labeled as classified to be classified, it either is or it isn't based on the nature of the intelligence, and only the agency that the information in question can declassify said information. It wasn't classified until after The State Department (meaning Hillary) had the intelligence. There isn't any smoking gun and they can keep coming up with classified memos after the fact all day, but that doesn't mean any of them were classified when she had them originally.

That doesn't mean it won't give the clickbait merchants clickthroughs and pageviews for their hitpieces and the GOP won't profit from the resulting dip in her poll numbers.

As someone who is fully cleared and has been read in on several SAPs, let me explain a bit:

SAP is not a classification. It is a limitation on distribution. Something can not be simply classified as SAP, it would secret or top secret + the SAP. There are some SAPs that are secret and some that are top secret. A person must be cleared at that level first in order to be briefed into a SAP. Only people cleared at that level AND briefed can see SAP material. This is opposed to regular secret or top secret material, which anyone with the right level can see.

What was in her email was probably information that was top secret + a part of a special SAP.

Now... Facts are what the government classifies based on what level of potential damage disclosing them to our adversaries could do to the country. Every program that involves classified information or work needs to create a Classification Guide. These documents list out the various relevant facts and what level of classification they are. If a fact is secret, any document it is put in must be labeled secret. Any place it is spoken about must be secured for secret conversations. Any email it is put in must be sent on a secret network. If a fact is SAP, then all of that applies, except the mediums must ALSO be secured for secret + SAP. SAP material cannot be sent over a vanilla secret network (also called "collateral secret").

Because facts are what is classified, stamping a document secret does not actually make it classified, nor does NOT stamping one make it unclassified. To label a document inconsistently with the classification of the facts within is just mis-classifying it, which happens often. Usually people overclassify because they're lazy and are already on a secure network, but sometimes people underclassify by mistake or they forget to check the Classification Guide.

Underclassifying something on a secure network is easily fixed by correcting the label. Underclassifying something on an unsecure network is an issue, and it's typically called a "spill". They're not fun, because once they are caught after-the-fact, the servers' hard drives have to be sanitized, computers have to be reformatted, some parts need to be destroyed... it's no fun. Usually people who cause spills do not get in legal trouble though, because it typically is a genuine mistake. People rarely try to purposefully leak classified information. They might get a permanent mark on their employment or security record, which would lead to an issue if they cause many spills, but that's it.

Regarding Hillary's email: everything I have heard so far is just that some emails on the server contained facts that were classified. That means whoever sent those emails wittingly or unwittingly caused a spill. It also means people who received them should have noticed that and reported it properly. That is all...

In order for Hillary to go to jail, the FBI would have to prove that she was sending emails on an unsecure server with classified facts that she KNEW were classified and not properly labeling them. Just providing evidence that she was briefed on the facts of those programs probably won't be enough. Classification Guides can run into 100s of pages and she was probably very quickly briefed into several in one meeting. She would have a strong defense that the DoS security personnel did not adequately brief her.

If she received classified emails, the FBI would have to prove that she knew the facts were classified and willfully did nothing to clean them up... Also very difficult to do.

FYI: all of this info is unclassified and in publicly available executive orders and policy documents.

No. The facts in the email were classified. They were classified when whatever program they're associated with was initiated and its Classification Guide was written. Then, someone wrote them into an email and sent it on an unsecure network. Thus, those classified facts were spilled.

It was long after, during the IG review of the server and emails, that it was determined that those emails were underclassified due to those facts. Still, it would be tough to prove that whoever sent the email did it on purpose, or that whoever received it knew it should have been classified and didn't report it.

Damn who's this person trying to defend Hillary so much? She is dead to rights when it comes to this case, and she pissed off the FBI so much they opened an investigation into the Clinton Foundation. They know it's opening a political can of worms since I'm assuming it implicates a lot of higher up people, but she must have really grinded their gears with her complete mishandling of classified information.

To be honest I don't think Obama will have any realistic choice but to indict Hillary, or more realistically blackmail intelligence agents so they do not recommend prosecution or leak vital documents.

I'm thinking Hillary will implicate a lot of higher ups in Obama's circle (maybe even Obama himself) if she goes down, so I figure he's going to do everything possible to avoid prosecuting her AND making sure the FBI doesn't exact revenge.
