there was a case in canada where some karate superblackbelt expert seriously injured an assailant during self defence, and the assailant tried to turn the case around saying that he (the assailant) was a victim of assault w/ deadly weapon because he (the karate expert/real victim) did not warn the assailant that he knew martial arts before defending himself
im pretty sure the assailant was convicted, but there is precedent about neutralizing the threat. it just depends on your jurisdictions laws; some places authorize the use of deadly force, others only allow the victim to use as much force as necessary to defend themselves. which would mean, in the case of the latter, you have to retreat as soon as you are able. e.g. if you are getting mugged and you use a knife to defend yourself and you cut the guy and he backs off, you now have to run away and call the police. if you continue to advance and stab this guy once he's no longer a threat, then you are now assaulting him (in some jurisdictions)
