They do not know that they are killing an innocent person when the truth is incapable of being absolutely completely determined and a misinterpretation throws everything into the wrong light. Thus, while it is unjust for an innocent person to die for a crime they did not commit, it is not strictly unlawful when there is no way for humans to know without omniscience and omnipresence.
