Yes, he was available. That doesn't mean he was free.
If it were the extra cost of a couple of actors to portray him, hell, they'd do it in a heartbeat. He's a non-speaking role so far, isn't he? You'd have the extra on set for a day. You could hire the costume pretty much anywhere.
The only reason to leave him out if he's that damn important that they wanted to reference him at all is because he's expensive to rent.
And by the by, since historically the rights were split, it makes zero sense for WB to have suddenly leased them in whole - as in, the rights to the entire Superman franchise as a tv show - to CBS if they only wanted to make a Supergirl show. You'd give them what they need and scale up the costs the more they wanted - otherwise, they'd just make a Superman show having paid bottom dollar for Supergirl, who has no fans.
