If the real explanation for the Joker never dying against all odds is that writers can't stop using him, why don't they make him a legacy character?
Kill him off, no retcons, no excuses, and then have someone else be the Joker now because it's fun. He doesn't have to be an established character or even have a backstory. Perhaps they could give the Joker a way to switch bodies like in Batman Beyond, so it's him but not him. They can continue telling stories about him without making him clearly superhuman.
His past is multiple choice to begin with, right? So who cares if his original body is destroyed?

You and I both know that they would be doomed to fail miserably if they tried it. And even if, against all odds, they succeeded, cremated his body, and took a shit on his ashes, he'd somehow come back as a demon or something and eat their souls before being stripped of his demon powers and given a copy of his original body. Joker stories sell like fucking hotcakes, and DC just can't afford to permanently kill off a villain like that (hell, neither of the Big Two can afford to permanently kill off even their C-List villains).

When that happens the mobs just haul up with Penguin or whoever until things sort themselves out. They're like parasites. They feed off Gotham but they're only so attached to it. If it dies they just go somewhere else. They don't have all that money and international connections for nothing. Very few of them are trying to make it a better place to live or help the citizens after all.
