Why won't the Batman kill?
I mean, he's perfectly fine with breaking countless other laws. He commits trespassing on a daily basis, stalks and assaults people physically and psychologically, uses illegal weapons (non-lethal, sure), but illegal nonetheless.
He employs military grade equipment, such as surveillance and vehicles. Needless to say he breaks speed limit laws all the time, etc.
You get the idea.
Because he knows he's a mentally ill fucker and that if he lets himself kill just once, he'll go full Punisher and start killing fuckers left and right with no thought of the consequences
Illegal doesn't mean immoral. Just because Batman may break a law he finds unjust or getting in way of doing what's right doesn't mean he'd do something he conciders immoral.

Because Bruce isn't a pure pragmatist. Seeing his parents get shot when he was 8 left him psychologically scarred such that he sees death as the ultimate evil, even if there's isn't a logical reason behind it. Bruce's "reason" is that he basically suffers from PTSD.
