However you want to call him Captain Marvel is drawn with a very unattractive face. By that I don't mean that he's actually ugly so much, he has a similar stylized 40s/50s look to Superman but whereas Superman has a delicacy to his features Shazam really looks like a brute.

The kind of 40s businessman who'd have cheated on arms quotas and raped his secretaries, or an alcoholic dustbowl pesticide salesman, rather than a news reporter.

You misunderstand, it has nothing to do with rights over IP or the character itself, but with the trademark, the "Captain Marvel" brand. That's why DC can choose to name the character Captain Marvel inside the pages of a story, but not market that comic with the "Captain Marvel" name. This is why even pre-New 52 his DC books are never called "Captain Marvel", but "Shazam: ________" or "_______ of Shazam".

Captain Marvel was pretty distinct aside from the obligatory power set. There was certainly some crossover but there's good evidence to say Superman was adapting as much from Cap as vice versa.

I went to my Barnes and Noble and in the comics section, Captain Marvel is designated as the one who pulls off the Maverick archetype without being two-dimensional about it, is what Hal Jordan would be if Hal were a good character, who's got Tony Stark's swagger and over-abundance of confidence, Steve Roger's discipline and military training, and raw power enough to rival Thor and who despite all that, is still very much her own character, with her own flavors of compassionate and flippant and humorous, who if I had to sum up Carol up in one word, it'd be "liberation" and that's a beautiful thing.

This store really fuckin sucks, all they got there is capes and dumb shit like Saga. Not a single Donald Duck comic or any super duper hipster crap aside from the new Clowes book
