The movies can use whatever they want. There are no restrictions in that direction. The TV shows are mostly bound to things only native to their franchise, but depending on what relationships they want to use in the TV shows they can ban even things native to them too (see: Captain Boomerang).

Technically, the rights are probably held by a shell company (both because it's tax efficient as a means of sheltering profits within the group and because it means they aren't assets that litigants could attempt to seize), and agreements to use those rights (in return for cash money, which is where the sheltering comes in) are as individual as you would expect of any licensed IP. In practice they may be less well controlled or under wider licenses (or the shell company, which likely has the bare minimum number of employees, simply never pursues breaches) but at heart this is a system by which both tv and film are required to ask for (and pay for) the licenses they use, making the decision to use various characters non-trivial as it should, in theory, incur a financial penalty each time. Otherwise they could literally fill every background with extras dressed as the Legion and it would cost them no more than the extras and costumes, as long as none of them had speaking roles (because speaking roles are paid and credited differently).

They've literally been calling her Captain Marvel for three and a half solid years now. Before that she was Ms. Marvel from 1977 (having been plain old Carol Danvers since 1968) until 1998, when she briefly became Warbird. After about a year she was removed from active Avengers roster duty for her alcoholism and didn't return in any meaningful way if at all until House of M, in 2005, when she was for the first time Captain Marvel (of the alternate reality of HoM), and thereafter Ms. Marvel until 2012, when she formally took on the title Captain Marvel with the blessing of the original, temporarily resurrected (for the fifth or sixth time). In 46 years she's had 4 name changes, two of them associated with giving her a less embarrassing costume than "bitchy drunk in a swimsuit and thigh-high boots". Or I guess six if you count HoM and the reversion at the end of it.
