I don't think so. I think it's just a matter of what manufacturers will allow to happen based on legal liability. They almost all are in ranges of 5 to 10 mph. It also appears that there's a problem with the battery life. Faster you go, quicker they'll drain. If there's a federal restriction in place, I haven't found it.

4MPH maximum for Class 2, and 8MPH for Class 3. Class 1 are manually operated wheelchairs.

It's not, really. Or at least that's not the main joke. The joke is generally that Kelly is a self-righteous blowhard whose idea of morality is "anything that even indirectly slightly inconveniences me is wrong and the end of America." And it's a jab at the cliches of political cartoons at the same time, like the overuse of the crying statue of liberty.
