Hello /adv/, am I fucked?
> black guy steal my keys, my credit card and my phone while I'm drunk
> I catch him 10 minutes later calling escorts with MY phone
> I ask him nicely to give me back my stuff, doesn't work
> I push him into a wall and take my phone and my keys by force
> He runs away with my credit card
> I kick him in the ass to catch him
> In front of cops
> End up charged with assault
If I get a lawyer and shit, who will be winning at court?
The guy doesn't even have any injuries
>>
Well it's not like you were doing it in self defence, so chances are likely that you'll be charged. Why didn't you lay a complaint with the cops yourself?
>>
>>16970529
I was drunk so I couldn't grasp the situation well.
I did try to grab him to take him to the cops and that's when he ran away
>>
>>16970538
>I was drunk so I couldn't grasp the situation well.
Unless you were so drunk that you had no control over what you were doing, that doesn't matter

>I did try to grab him to take him to the cops and that's when he ran away
That's not what I meant. What you should have done is filed a report with the police instead of trying to be a vigilant and get your stuff back. You could file a report now, but I don't know what they'll make of it
>>
>>16970516

you were preventing a robbery. did the cops see what happened after the fact? as in, did they see you take your card back? did they make him give it back? any other witnesses to speak of?

as for the escort agency, he seemed to know the number, so he must be a regular. proof he stole your phone? evidence is evidence

what we say about whether or not you will win is pointless. go to your lawyer and cook the best plan
>>
>>16970547
>you were preventing a robbery
No he wasn't. The robbery had already happened, he was taking matters into his own hands and assaulting the other guy in the process
>>
>>16970529
>Why didn't you lay a complaint with the cops yourself?

Because OP didn't want to have to pay for new stuff and fight fraudulent charges on his credit card. OP wanted his shit back. Filing a police report doesn't save you the cost of a new phone.
>>
>>16970546
Yeah I was badly drunk, like half a bottle of vodka.
>>16970547
He called many escort and I still have the numbers and the history on my phone.
>did they see you take your card back
No, I want him to use it to have proof that he stoled it. I was sent to the police station so I have no idea what he's doing with it atm.
The cops didn't left much of a chance to explain myself.

>>16970550
I mean, the guy was running away with my card and I wanted to catch him, not harm him, that's the point.
>>
>>16970550

im no lawyer. but i highly doubt the court smiles upon those who attack before your shit is stolen as opposed to after the fact.

he was runnign away with his stuff, he caught him and got his stuff back.

put that in front of a jury and who do you think they are going to side with? and lets be real, racism is gonna help.
>>
>>16970564

>i want him to use it

you didnt tell the cops he stole your fucking card and to search him and they'd find it? you had an entire ride home with them you could have explained this on.
>>
>>16970564
>Yeah I was badly drunk, like half a bottle of vodka.
Well it's going to be up to you to prove that you were so drunk that you didn't know what you were doing. That's going to be difficult or expensive or both, and I don't think you'll be successful.

>I mean, the guy was running away with my card and I wanted to catch him, not harm him, that's the point.
The fact is that you did assault him though, and now you're being held accountable for it.
>>
>>16970570
>racism is gonna help
nope, I'm from a minority myself.

>got his stuff back
I did not, that's why I kicked him, I wanted to get my credit card back.

>>16970574
They didn't care, they cuffed me and I was sent directly to a cell.
>>
>>16970564

what country do you live in? they need to have a victim in order to file assault charges so he would have been brought to the police station with you. with no one claiming you assaulted them, even iwth cop witnesses, how are you supposd to defend yourself?

you could have told them a thousand times 'he stole my credit card'
>>
>>16970587

>they didnt care

if you insisted he stole your card, tell that to your lawyer so the cops can be called into question to. but it sounds like you arent telling us the whole story here cuz its oddly convenient.
>>
>>16970570
I am a law student and you're right, the law doesn't approve of people who attack before shit is stolen. But it also doesn't approve of people taking the law into their own hands and trying to resolve crimes themselves. If there was any time that an attack by OP was justified, it would have been during the robbery, not afterwards.

Not all cases go before juries either, btw.
>>
>>16970599

>when the guy is running it is after the robbery'

you are still being robbed when a guy is running away. the robbery isnt over just cuz he said 'no' when you asked him to give it back.
>>
>>16970591
> they need to have a victim in order to file assault charges so he would have been brought to the police station with you. with no one claiming you assaulted them, even iwth cop witnesses, how are you supposd to defend yourself?
Wait, is it how it was supposed to be? The guy stayed on the street with the cops and didn't come with me at the police station.

>>16970595
>but it sounds like you arent telling us the whole story here cuz its oddly convenient
Well, it's how it is, I'm not some violent retard with a criminal record. I'm a student and haven't been in a fight since elementary school.
>>
>>16970613
>10 minutes later
>not after the robbery
The robbery and the assault were two distinctly different events. The guy wasn't running away from the robbery, he was running away from the assault.
>>
>>16970621
Isn't it considered robbery when he stills have my card with him?
>>
>>16970628
The robbery itself is over. He's just in possession of stolen goods at that point.
>>
>>16970637
So the best thing to do in such case is to just let the guy go with your stuff and call the cops?
I'm asking because I've already been robbed in the past and never got my stuff back after going to the cops.

Anyway, are we talking jail or a fine here? The guy doesn't have a bruise.
>>
>>16970652
>So the best thing to do in such case is to just let the guy go with your stuff and call the cops?
Yes. You also call your credit card company and get them to cancel your card. If this isn't the first time it's happened to you, you need to either move or look after your shit better, or both.

>Anyway, are we talking jail or a fine here? The guy doesn't have a bruise.
I don't know, I'm not a sentencing judge. Why don't you ask your lawyer like anyone who has half a brain would do?
>>
>>16970637
you're a fucking moron. was this robbery only the fraction of a second that they were both in contact with OP's wallet?
>>
>>16970666
Are you saying that 10 minutes later, where the guy has got away and is making calls with OP's cellphone is still part of the robbery? When does it end then?
>>
>>16970662
>Why don't you ask your lawyer like anyone who has half a brain would do?
Yeah, that's what I'll do, I just wanted to relief some stress because this whole thing is fucking me up.

Anyway, thank you all for your replies. I see a little clearer now.
>>
This is /pol/-tier bait and a fake ass story

Fuck off
>>
>>16970677
If you're ever in trouble with the law, get a lawyer. Don't sit and ask 4chan, because most people here are idiots who have no idea how the law works.
