Do you seriously think this Roman-like army would ever surrender? Regardless of what the soldiers want, the officers/generals would never let them. In this kind of era they have the stupid mentality that it's better to die in battle, then to live in shame, they're also idiots with high pride (nobles and such, who've stupidly been given high positions despite their incompetence). Additionally if they retreat or surrender without orders from the top they'd get executed on the spot. Remember everything they're doing is under Emperors orders and disobeying means death.
The other thing you've completely forgotten, is that every since the shithead became Emperor every soldier is being threatened, if they disobey their family and friends will be imprisoned or killed.
