I'm not aware of a lawsuit of this nature which would cost billions let alone a few million. Peanuts to both parties involved. Unless you mean sue the video creator (which is clearly the only logical thing to do.) There would be no damages only an injunction otherwise.
This is all irrelevant because the case would probably get a summary judgement for vid creator early on as the precedent is clear (see Suntrust v Houghton Mifflin) it might even get a dismissal and possible sanctions.
EA really are a terrible publishing company. They ruined a lot of otherwise decent games. They were so big developers kinda had to use them to make money.
I'd be suprised if EA can publish their lawsuit efficiently without their prosecution having missing documents, incompatible statements and so forth.
