Basically neither the shirtless man or the two men harassing him would be considered an "innocent". Neither side was a danger to anyone outside of the parties involved, therefore there was no legal justification for a 3rd party civilian to interject himself into that situation. Navy Seal dude is therefore just a man who came up behind someone else and attacked them with no legal justification. Shirtless man could sue him.
But no criminal charges, because legally, all three parties in that are equally at fault so any arrest would have to be performed on all of them and it's just not worth the time or effort for most police to do that. You've never been in a fight. You never take a seat when someone is toe to toe with you as the process of taking a seat puts you in a vulnerable position to be attacked. You're not in a defensive stance, can't keep your eyes on your target as well, and can't counter-attack as required. I've been in quite a few fights mate. I've seen a fuckton of a lot more. What else is there to do friday nights up here in fort mac? Cops aren't usually called, but the few times they are its because of situations exactly like this Navy dude. Some asshole jumping into a fight he has no business being in. Sometimes they get arrested, but they always get kicked out. Not just that, I can draw my gun on anyone here without "stand my ground" laws too. It just means I can't shoot them for being there right away. I have to wait for them to come at me which is still fucked. But even if I shoot them I will be fine in the law. But citizens arrest applies throughout the whole US. If you see a person commit any kind of crime you can legally detain them until the police arrive. Most people don't take advantage of that (clearly it would be a dick move if it was jaywalking or something) but a lot of people just sit back and let people get hurt/robbed/murdered because they are scared or just don't want to be sued.
