The fact is, new consoles have to compete with old consoles the same way that automobiles do. If they put GC games on the WiiU, but not the specific game John Q. Public, Johnny may go out and buy a refurbished GC and sell his WiiU. Not to mention a Virtual Console Twilight Princess would have eaten into the HD edition's sales. You still don't see Majora's Mask on the WiiU, I bet they regret putting OoT up. Also, ig they don't put GameCube games on WiiU and they don't put DS games on 3DS, they won't be advertising superior system choices to people.
After all, the Gamecube has ten times as many games as the WiiU and most games cost less than fifty bucks. The older I get, the harder it becomes to justify purchasing new consoles. But I was a GameCube kid, which means I can now experience most of the PS2 library for the first time ever at a fraction of the cost of a PS4. A DS would be a more economic purchase than a 3DS and you would have more games.
The video game industry really doesn't want us consumers to figure this stuff out. The only people who should be buying new consoles are tech savvie types who want the newest stuff. Me? I want games. I'll try out the Sega Saturn before I ever buy an NX.

The actual answer is that the DS mode doesn't have access to the SD card slot. This means that not only would they have to repackage each game as a DSiWare title ala WarioWare touched, but they would be installed on the device meaning space would very quickly become an issue. The only other option is to remake it as 3DS ala AA Trilogy, which is also a pain.
Don't listen to the memers, it isn't reasonably possible for them to do.

DS games can only run in DS mode on the 3DS, and the only way to make digital titles run on DS mode is repacking them as DSi. DSi titles have a fairly small size limit, so a DS virtual console would have a very limited library.

Nand memory chips are vastly different in design and functionality to SD cards. There's a reason why nands usually don't exceed 8 Gb though I think Samsung made a breakthrough with that recently.

If the file size is that small, what if there was a "DS player" app on the system that leaves that much space open on the system memory that loads the game from the SD card before running it?
The app could make a copy of the game in the system memory like loading a DS cart, and when you want to swap game it writes the save file to the SD card and deletes the game file to be swapped with another.
An app like that could potentially also be used to transfer your save data from physical carts to digital versions.

But what's wrong with that? As far as I can tell it's just a read/write function that checks if you own the game like any other digital game. The game could stay on the system memory until it's "ejected" and deleted to make room for another.
