They approached him and he said he never wanted to do Tony Montana again, it's not a game thing, he just didn't want to do him again. But he agreed to pick the voice actor who did play him, which is why the guy does such a good job. Pacino picked him personally.
Underrated game, way too much grinding though.
Launched in 2004 just before World of Warcraft. In 2006 the company running it announced it was closing/selling and an attempt was made to raise funds to buy the source code. That fell short and the company that bought the game eventually went bankrupt in 2007.
It's been run as a free to play game since 2009 and in 2010 the source code and art assets have all been released under AGPL / Creative Commons. It still has enough of a following that it managed to get greenlit for a Steam release in May, but it doesn't seem to be getting good reviews there.

He didn't want to do it because he fucking said he can't do the voice anymore as chain smoking fucked him up and said it wouldn't be genuine. That's why he recommended his own personal replacement sound-alike actor.

Really good game, but it got kinda hard to do drug runs later on to buy shit for your house and I hated that all the furniture would disappear if you try to change the look of the house. Amazing soundtrack btw
