BTW none of this ESRB shit is run by the government or government mandated, so you can't really blame America. Most physical stores require a game be rated by it in order to sell it, because they want to retain a "family friendly" image. That's why the ESRB restrictions are so widespread, game devs want to be M rated or below or else they'll have nowhere to sell their games. Although this is changing with digital distribution.
