They absolutely can fix those issues, they have the resources to do so, they are not in any way motivated to fix them and that's the reason.
Nobody is NOT buying Skyrim because it has performance issues, heck when Fallout 4 came out people defended those issues with the same logic you are, that they can't fix them.
Think of Minecraft, do you honestly think that the performance issues couldn't be fixed? Ofcourse they could but nobody is NOT buying Minecraft because of those issues.
If you want these issues addressed you'll have to gather a mass of people and tell the developer that you aren't going to buy those games until they fix those issues.
Good luck with that though, i just played the beta of Dead by Daylight and that game has severe network issues and lack of features, you can't even host a party with your friends to look for online games together, yet i'm the only one of my group of friends who didn't buy the game because of those issues.
Having a simple lobby system is something they can implement but they didn't, they wanted the money earlier and they got it. They even said that, that party system is coming anyways, so take that for what you will but i won't buy into any more empty promises.
