Yea, its the purpose of the law in the first place. But there are a lot of "but"s in there. One has to actually use that trademark for it to have any legitimacy. If this trademark was registered in 2002 and it hasn't been used anywhere, then it is very hard to assert ownership over it.

When this law is used like it was intended to, then companies would sue those people who have too similar trademarks. Often times they don't even do this to win, but just to show that they are willing to sue any kind of infringements - essentially asserting their ownsership over their property.

A trademark is more than a word, its a combination of factors that creates a brand or identity for that company.

Its not as simplistic as to just say "I trademarked the word Carp for my toilet paper company" and then go off and sue another company that sells CDs called Carp and win. There has to be many links between the brand being protecting and the infringement of the other brand, just being called Carp is not enough.

If a company came along though and was called Carp and sold toilet products, its more likely in that case the first company would win.
