Sony still has a form of Spidey game rights through the movies, so Sony lent them to Activision for the ASM2 game. This was shed a bit during development blogs when talking that their costumes and villain choices were limited by what were in the film rights and that they couldn't make another Shattered Dimensions game and could only do movie games.
Disney then shut down their console making arm and are focusing only on mobile games and licensing IPs out, and considering it's confirmed on Playstation Blog this isn't based on the upcoming movie and is an original story, it seems likely that Disney/Marvel licensed the rights to them since they already had the Movie!Spidey game rights.

Treyarch is also responsible for 3/5 of the great spider-man games (spider-man 1, web of shadows, and the 7th gen spider-man 3 games). The other 2, the PS1 spider-man and Shattered Dimensions 1, were made by other studios.
