The game may be using licensed tech from a third party, like the 3d engine, audio tools, physics or console dev tools. If there's been a breach of security at their company that let this get leaked in the first place, then the source code or whatever for that tech may also be compromised. This can cause the licensee of the tech to not work with the company again as well as stop other companies from working with them and possibly bring about lawsuits for their lack of security.
They can do PR to fix their public image but they've got to keep in good standing with the industry itself.

Even if you do want portable Oblivion, what you probably don't want is to play Oblivion at even lower than lowest settings, at 24FPS, on a system with one analog stick, with everything scaled down and chopped up just to barely function on such a low end system.
