Nostalrius was going to release separate servers for BC while keeping the Vanilla ones intact. Everyone seemed super pumped about it because BC was even better than Vanilla for most people.

Also, even if only 30k people gave a shit about vanilla, that's more than enough to populate a server constantly.
I'd play a official vanilla server. Shit, I'd even pay for one. Just to try something different but familiar. Lets be honest though nostalgia is a big driving point for many of us though. Unfortunately that would mean the huge number of people at the start would die off pretty quickly. Either that, or Blizzard would introduce "quality of life" improvements akin to what Runescape did with OSRS (Grand Exchange (Auction House-ish feature), new content, etc). I would be against those (mount price, length of buffs, stuff like that) but there are people who would be in favor of them.
But like I said I would sign the fuck up right away and use a random race/class to try new shit. I get caught up in thinking "what should I play?" too much.

They didn't actually infringe copyright though. Their servers didn't have any art assets, names or shit like that, it simply had the AI for bosses, mobs, and certain mechanics. This is why Private Servers are such a grey area, so long as they don't copy the original code (which they can't, since they don't have it), they aren't technically violating a copyright law. However, a person downloading a client and using their server to access that material without a license is.
There isn't actually any clear legal precedent regarding private servers. What it comes down to is Company X issues a C&D, and Private Server Y cannot afford to contest it in court, therefore folds.
