Yes, they can. When I had my 3DS replaced they gave me an entirely new serial code and logging into my NNID gave me no games. I had to phone them up and they had to manually link my old purchases to the thing. They have their own way to check what you bought on your account and what was there already on their side.

Not true. The games won't show on your NNID. It's not connected to your account so of course it won't show up under recent software or purchases. You need to search the game manually and it will let you redownload them because it detects the ticket on your console.

It was actually because the market was over saturated with low quality crap everywhere, and the major players at the time (atari) lowered their own standards.
Seriously, even the likes of Quaker oats were making vidya in the run up to the crash.
I hacked my 3DS a few months ago, but I can't tell which one is the emuNAND and the sysNAND when I start up. Also, I don't know how to restore the back-up of my NAND so I can get my damn streetpassed Miis back. Now my 3DS is just rotting somewhere because I'm too lazy to figure all this shit out.
