what you have to remember about this is they consider the data copied to be a separate actual copy of the game and not just redistributing the data you already have into your own network. when you downlaod someone elses backup thats going to be considered a separate copy completely of the game, when you backup your own copy its just considered preserving data you already have

You can convert a .cia back to .3ds to play on a Gateway, but not a Sky3DS.
Gateway is basically the same thing as a CFW, except the cartridge is also a DRM dongle.
Sky3DS plays .3ds files, but they have to be unmodified, 1:1 copies of 3ds carts and a converted .cia is not one of those.
