It's called softban because you're not entirely banned from multiplayer game, you're just put into a server where you can only play with other softbanned players. Playing in the regular servers is a privilege, not a right.

Well, it's more like your very specific, individual right to enjoy your game is not more important than the collective rights of every other player to enjoy their game. Cheating/hacking/network manipulation makes the game worse for everyone but you.
Cheating is no fun if everyone else is cheating, then it just becomes playing a game with different rules. That's why cheaters hate softbans. If the softbanned cheaters wanted, they could all stop cheating and play fair, then the two groups would be functionally identical. But cheaters won't stop because they're shit.
A softban doesn't take away your right to play the game. You still get to play the game, you just get to play with a group of like minded people.
