Okay suppose you and the guy above you are taken to nintendo and you can get a free copy of the Nintendo NX before the public however theres a catch;
If you both want it you both will have to pay $500 and you both don't get an NX.
If one of you wants it and the other doesn't the person who wants it will get it while the other has to pay $1000.
If you both don't want it you can leave.
You don't know what the other person is thinking and can't communicate or see the other.
What do you do?

Yes it does, just a significantly reduced consequence. In the original scenario of going to prison if you both talk you'd both get 5 years of jail; if only one talks then the other person gets 20 years, for example
