Not him, but I do at my diner in California ($10 + tips). Diners are pretty hellish compared to classier restaurants, since the average turn over rate is 20-25 minutes and the checks are always a fraction of other restaurants per person. Not to mention the massive amount of kids and foreigners that come through, which are generally very ease to serve but rarely leave tips. Also, no bussers or hosts, and people can order to-go via phone or the front cashier (which the servers have to man while still taking tables). You run practically non-stop, but the pay is worthwhile if you've got the stamina for 8 hours of fast-pace, high stress work.

Also, fuck people that don't tip out the cooks. It's disgraceful how rampant that is even at my place.

It varies. The actual law in California says something like $2 or $3 minimum for tip-paying jobs and that the company must supply the rest if the tips don't get them to at least the state minimum ($10 right now).

However, the place I work at practically has to offer the full $10 to get enough applicants to keep it fully staffed. You hear "$10 plus tips" and think people would be fighting tooth and nail for that sort of job, but they really don't, and people come and go often. We try to make sure anyone hired to work tables has at least 2 years of prior experience in food service, but sometimes you just have to make do with what you got.

Not him, but at my place you declare them at clock-out. It compares the inputted number to your total sales and your credit card tips (which are, of course, digitally recorded in the first place). Inputting a number less than 8% of your total sales or less than your credit card tips, it sends up a ton of red flags (under 8% means the company must pay you the difference, so they bring the hammer when it happens because they know the server is a lying son of a bitch, and less the creditcard is self-explanatory (although stupid when you consider tipping out the cooks)). Other than those two restricts, it's pretty much free-game.

People make between 15% and 20% of their sales in tips and typically only declare it as 8.01%. Considering that's most of your income, it can really make a difference when you're only declaring around half of it. I personally declare full because I like having a real, total, accurate reference of how much I made over the year on my paychecks, but sometimes I can't be assed to count all of my tips after a long day and go with 10% for convenience.
