That's not how it works. They can't copyright the over all story but they can certainly trademark and copyright likenesses.

Yea, but since their story wasn't original, they can't file anything against them for basing their game off it. As for the likeness of the characters, that could easily fall under parody.
I'm not sure if they want to pursue any "likeness" cases either due to the fact that they out-right copied a lot of designs from Thief and the Cobbler
