There are very few examples where new has a legal standard. Shit like cars with rebuilt titles. Video games don't, and if you are trying to argue that it is an unfair misrepresentation, you'd lose too because 1) it IS new, and more importantly, 2) you can see very much what you are purchasing before you complete the transaction.

I am a dealer in a casino. I make about 25$ an hour and the casino pays me 5.25$ an hour. There is no way in fuck a casino would pay me 25$ an hour to do this shit. Management makes less than i do. if they went to a base wage with no tips id just go get a real job and 99% of the dealers would be fresh off the boat asians with the remaining 1% being a dumb wetback for diversity. The same goes for any upscale restaurant.

If you start filing for this regularly, they can and will fire you. Even in non work at will states, they can just make up any reason ("you weren't a good fit", etc) and unless somehow you have proof otherwise, there isn't anything you can do about it.

Former GameStop employee here. We couldn't sell those display copies as used, but we could knock some money off of the price if it doesn't include inserts and the box isn't in very good condition, only if the customer asked. We didn't sell those copies either unless we had no other new copies. That's just a dumb move. We'd have to get another new copy to use as a display copy then. For most customers they don't really care. They should though, in my opinion.

GameStop makes the majority of its money off of used game sales and preorders so we didn't particularly care about customers coming in asking for new games directly, which is why we never had a huge stock of them unlike major retailers like WalMart and Best Buy.

I was a delivery guy for a restaurant and I still can't fathom why people order food to be delivered if they have a car. It was a small city with very easy commuting/little traffic. Sometimes the food would sit in my car for upwards of 30 minutes because they ordered juuuust after someone else.

Fucking pick up your food, get an estimate on when it will be ready, and get there like, 3 minutes before that. You'll get to your own house faster with it and it will be much more fresh. And you won't have to feel like a piece of shit for tipping little or none.
