I'm not wild about the idea of a jury determining what constitutes public good (or knowledge, or private, or journalism) and that's where I see the disturbing precedent (broad sense, not legal sense) being set. We've seen decades of the rich and/or powerful abusing the courts to silence criticism or embarrassing information and the perilously slow response of the legal system to respond to that behavior. If you think the fallout of this is limited to celeb sex tapes though, you've got to broaden your mind.

Even if I think I will prevail, court costs will be ruinous and my fate will be in the hands of people who live and work in an economy that owes far more to Floyd than FL's did to Hulk.
That's why it was shitty when SchiavoJudge denied summary judgement, it's why it's shitty when it's applauded because of a reflexive Fuck Gawker (though it's useful for determining whose ostensible support of free speech is overpowered by their hatred of another Gawker property), and it'll be shitty if this doesn't get smacked down on appeal. Even Freedom of Speech has limits and just means that the government can't stop you from saying things, but there are still consequences for saying things.
Freedom of the Press simply means that they don't have to run a story through the government first to make sure that nothing goes against what they want the people to know. Just because they aren't stopped by the government, doesn't mean that what they post is right or just and if it infringes on the privacy of an individual or if it damages an individual, they can seek damages.
That was the whole point of Slander and Libel, protecting the individual from those that held more power. More power, means more restrictions, or at least it should. That's the way that it use to work. It's also why companies pushed so hard for being able to be treated as people/individuals, because it then afforded them these same protections.
