He isn't the final boss because Drac can't die and was able to enslave him.

Because it's more like Japanese death, a Shinigami.
They are grim reapers, or spirits, something like the valkyria. They just take the dead souls away. They have no omnipotence. The just got their scythe, which allows them to do their job.
Better question is, Is there a game where you fight the actual death? How would it be to fight the actual thought or concept of death?
The closest I can only think of Persona 3, where you get to know and fight the physical manifestation of Death as final boss, which appears in several manifestations throughout the game. And it's even impossible to destroy it that you got to seal it with your life.
