I mean I guess. I doubt that Fromsoft or Bandai Namco would pursue though, considering it's a small studio. Even if they were to, it doesn't share any of the characters, locations, or any story elements with the Souls games, so while there may be "grounds" to begin a lawsuit, there isn't enough to actually guarantee a success. They could just outmoney them, but there would be no point.

You need some 1:1 comparisons first. For example, using the same names, same fictional location, and so on. As for gameplay, you would probably either need the exact same gameplay in both games, or at the very least they would have to copy the source code to a degree.
