See Guilty Gear Izuka and Dungeon Fighter online. Yes both games have their flaws.

The problem is not the genre but modern gamers, game design and what counts as successful.

Hard to do because the formula is fairly ancient (in video game terms) and people would have different ideas of how to properly update it. Probably the best option would be to encourage a bunch of companies to make new ones and see which ones work out best.

Assuming we are sticking to side-scrolling, I would think that 8-way movement with 6-way attacking (that is: right, up-right, down-right, etc. but not up) would give a lot better control than older beat'em-ups did while still keeping the same style of play. You'd probably need "taller" stages to make diagonal movement and attacks more practical.

If you are fine with going into 3D, then Musou and Senran Kagura have some good ideas (if not the best implementations).

Give them a theme. Isn't that new TMNT a beat em up? What about transformers devastation?

I wouldn't mind seeing a well done Megaman beat em up. Or DBZ, or Marvel, Or G1GI Joe.

3D Action games are kind of the modern beat em up in a way.
