#1: Obsidian isn't Josh Sawyer, so "Obsidian gets to be creative and make whatever game they want" isn't "Josh Sawyer's autistic playground game"
#2: They pitched it as an IE-styled game. Sure. That doesn't shackle them to game mechanics since they don't even have the D&D license (Though they could have used D20 if they wanted), and that doesn't shackle them to Somehow Even More Generic Than Forgotten Realms fantasyland. IE-styled game basically means party based RPG and real time with pause.
