The Gamestop employee assumed OP was buying used given that OP carried the used case up to the counter and asked for the game. When you pick up the pre-owned case with the pre-owned price tag on it and bring it up front to buy, the cashier is going to assume you're buying used. Because that's what you do when you buy a used, not new, game. If you want a new copy, you just ask for a new copy and don't carry the cracked, jizz-stained case from the pre-owned shelf over to the counter.
And why would you buy anything new at Gamestop anyway? Buying used is the only reason to shop there in the first place.
