Assuming you can play online, Super Mario Maker is really good. As is Donkey Kong Tropical Freeze, Yoshi's Wooly World, Sonic Lost World, Windwaker, and NSMB U.
Plus, Pokken, Star Fox, and Twilight Princess are coming out this year. Surely all these will be at least worth a pirate.

DLC and virtual console games are handled in a completely different fashion, if the 3DS is of any indication. It'll be some time before you can pirate anything but base games, I'd imagine.
