I think it started with Schism, where wolverine took half the cast and started his own school, and cyclops continued the Xavier institute. He went way more open and tried to become the second Avengers, but with mutants to try and build positive relations with the surrounding community. He proceeds to do everything wrong, constantly fucking up and ruining everything. He turns from "I want them to like us" to "I will make them like us." and became a mutant terrorist. Read Uncanny Xmen Vol 2 (2012) for fuck uppery.
AvX was where Rightclops came about. Mostly through bad writing, Cyclops wanted Hope to take the phoenix and rekindle the x gene in humanity. And the Avengers lead by Cap wanted to kidnap her, through force and bring her to the moon to keep the phoenix from entering the atmosphere. Shit goes wrong they go to war, and hilarity ensues. The best thing was when Cyclops seals the San Andras fault line. Afterwards he becomes a badass freedom fighter on the run from the law, and ruining people's day to further the mutant cause.

Capcom didn't have any choice in what Marvel characters got in to MvC3. Marvel gave them a list of which of their characters could and could not be in. The only way Capcom could reject a character was only if said character couldn't work due to technical limitations (e.g. the Human Torch; we got Super-Skrull as a substitute). The only exception was Shuma-Gorath, due to the fact that he was only ever popular due to MvC, and Capcom played on that when convincing Marvel to let him squeak in as DLC.
Therefore, Cyclops not being in is Marvel's fault.
