The NX is going to flop for several reasons:
1. The timing of its release. It's one of those awkward between-gens consoles, so Sony and Microsoft will simply release more powerful consoles, as well as predictably doing a pricecut on their PS4 and Xbox One consoles; making them more attractive options than the NX.
2. No games. Nobody will want to develop for an awkward between-gens console. Instead, they will hold out for the next Sony and Microsoft console.
3. Nobody bought the Wii U, even though it had tons of great games. That shows Nintendo that nobody buys consoles for games anymore, but rather, they buy them for Netflix and to watch youtube videos like on their little "smart phones" and "ipads". So they're alienating the few people who actually buy video game consoles to play video games. Which leads me into my next point.
4. It will have no advantages over the competition. A console needs to have SOME sort of advantage over the competition, whether it's cheaper, it has more and better games, it has better graphics, it has an interesting gimmick, etc. The NX will have none of these, so a few stupid people will buy it then the sales will fizzle out. And look at the rumored gimmicks that have been floating around. Cloud processing? Seriously? Like that's gonna get people to buy it? Upgradable console? Terrible idea, hasn't been done since the N64 and it's not like Sony and Microsoft won't have some way of countering it. Fusing home consoles and handhelds? Again a terrible idea.
5. There's simply nothing to set it apart from the Wii U. They're not doing anything to make sure that this console will be better than the Wii U, so I don't know why they think it will sell better.
My prediction is that the NX will sell about as well as the Wii U, give or take a bit, and then Nintendo's next console will have good games and will sell well. But if they keep this shit up of making several failed consoles before making a good one they're eventually gonna wind up on Steam.

They don't necessarily have patents for every feature the console will have, and your opinion is just your opinion.
I personally think that a controller with a free-form screen and scroll-wheel shoulder buttons is a great "gimmick". I also think that a machine with no disc drive but with cartridges is a great gimmick. I also think that if they want to add in the functionality to cloud compute or to link consoles, that's a great secondary feature. I also think that a hybrid console is - wait for it - a great gimmick.
Oh, and food for thought, you don't have to patent the strength or price of your console. The NX could theoretically be 1000x the strength of the PS4 at a price of 20 USD. Would you still call that shit?

I bought a Wii U at launch. I easily got my money's worth out of the console, so I fail to see how NX would be a "fuck you" to me or any other owner. And backwards compatibility would allow Wii U owners to carry their library over to the NX while also allowing NX owners the ability to purchase and play Wii U games they missed out on.

That and the fact that every single publisher does the same thing when localizing games for different regions. It's common knowledge that Americans are typically cool with violence but less so with sexual content and other places are opposite. That's why the Japanese tend to tone down their perversion a hair when releasing a game here and why companies like Valve remove all of the blood and gore from their titles when they release them in Germany.
