This problem is actually REALLY easy to fix. Mine had the same issue.
Literally as easy as cupping it in your hands and breathing on it to heat it up a little bit, which relaxes the plastic and helps you manipulate it into the proper position.

I'm not expecting a figma for $13, but I expect something that isn't trash. The action figures I had back in the day were like $7 and they could be posed and were about twice the size of an amiibo. These are $13, and while most of that is for the in-game function rather than the character on top of the base, I still feel it's justifiable to expect them to at least not look about on par with a chinese bootleg. The toys at the local mcdonalds have better quality control than this, I'm dead fucking serious.

the amiibos have been on sale for about 3 days. If an employee catches the defect, they'll probably have sent it back. people aren't buying them just for the figurines though.
when you buy a toy off of the shelf, usually you're not buying them the day of release. if you were, you would be more likely to find a defective toy than if you bought one months or even years after release date.
especially when you consider that Nintendo doesn't have a long history of making figurines (though it certainly has made them on a smaller scale in the past), it's understandable that there are defective ones. excusable? maybe, maybe not, but understandable for sure. Its not like the chip, the actual reason to buy these things, is affected by this.

Because that's just what happens to soft plastic, either due to a mishap at the assembly or just gravity taking it's toll. I used to collect Transformers figures, and if you left certain props or pieces in the wrong position, the same thing would happen. There are tons of shit that's wrong with Amiibos, but don't blame them for a problem that's A, easily fixed, and B, an issue with almost any figure or collectable that uses this material.
There's no reason to complain about it's cost when the same thing happens on a 50$ toy.
