What we saw was not a fluid single copy of the game. The ESRB not seeing the full roster to a fighting game they are rating makes zero sense, especially when you consider that they were shown a handful of the hundreds of trophies in the game showing questionable content. If we knew in what point in time each pic was taken, then we could say if the roster is final or not. This is not the case, so we can't tell.

Mii Fighter replaces the random spot. There is physical room for 5 more characters, but any more than the 1 I mentioned would completely fuck up the character select screen order. And based on the how the starting roster is ordered, characters are not going to be jumping positions around like Pikachu did in Melee. Not when it moves too fast, and constantly. That's the problem. Most stage hazards are periodic events that are almost unpredictable. That makes them funner; they don't overstay their welcome. On the moving stages, you are constantly, CONSTANTLY moving instead of fighting. Rainbow Cruise is fine, Ice Climber's Mountain summit is not.

Notice how the characters are in the same order. When other characters are unlocked, characters only move to the right or to the beginning of the next row.
Any characters besides one of the ones I stated above would break the order.

Where does it explain why Yoshi is in the middle of Mario reps? By the post you have quoted, to fix the problem we should consider the leaked roster "taken in a different time", meaning that, to fix it ad put everyone in his place, more characters are needed.
I also agree that things can change (from Melee's "who gives a shit" roster to Sakurai's autistic Brawl Menus), but you have to admit that it's a point to consider, and not to dismiss just saying "hurrr, things change, even when they fuck up everything in the past" (this is not yoshi's placement case, but you get the idea)
