The reason Yogscat are not accountable is that they didn't set up the kickstarter, therefore the money is not their problem. They used the little dev team to set up the KS so that all the shit would fall onto their lap if development fell through. Although I'm pretty sure they would have taken a cut of the KS money behind the scenes. It would be pretty funny to see them go away for money laundering, honestly.

The terrain will look it's absolute best before you fucking touch it, everything you do will make it look more like Mineycrafta. Yogscast didn't convince their fans. Winterkewl convinced the yogscast that they could do it. And Winterkewl aren't some retards or "amerturs" they're a small group of Dreamworks animators/developers whatever you call them.
Yogscast believed them and helped advertise the thing and allowed them to use their characters' likeness.
If anything the Yogscast is fucked even more so right now than most of the donators.

Yogscast can go fuck themselves, the people who kickstarted are the ones out money. The Yogscast are equally or even more responsible than Winterkewl. The Yogscast got the game Greenlit, the Yogscast got the game Kickstarted, hell if you even look at the the backer's rewards many of them feature things that can only be done by the Yogscast giving them permission, this includes:

When asked about the situation by people attending the con the hotel said that they'd never asked for the extra 17,000. On top of that, the main way of donating the money back was through an online site that only actually gives the donatee the money a few days after money is donated, so it would be impossible for them to have paid the hotel in time that way. So yeah, it was a scam.

A character TD may be able to do lovely rigging, but will it be set up just how the animators like it?
