TL;DR: SOME STAR CITIZEN RUBE DEMANDED REFUND, ACTUALLY GOT IT BY GOING TO THE DISTRICT ATTOURNEY AND FTC, LAWYERS NOW SMELL BLOOD

>A dissatisfied Star Citizen backer has managed to earn a full refund of $3,000 USD from Cloud Imperium Games, in a struggle dating back to mid-June. The backer, who goes by the name ‘Streetroller’ (their real name has not been shared), successfully received their refunded sum after filing a complaint with the District Attorney of Los Angeles.

>Correspondence between Streetroller and Cloud Imperium Games (CIG), as well as letters between the California DA’s office and CIG’s legal counsel Ortwin Freyermuth, can be read here. They were originally posted on the SomethingAwful forums.

>In the correspondence with CIG, Streetroller contends that he is entitled to a refund because Star Citizen “remains unfulfilled and no longer constitutes the product(s) I originally purchased”. That refund request is swiftly denied, with CIG citing their Terms of Service. Specifically, a passage which states: “For the avoidance of doubt, in consideration of [Roberts Space Industry’s] good faith efforts to develop, produce, and deliver the Game with the funds raised, you agree that any Pledge amounts applied against the Pledge Item Cost and the Game Cost shall be non-refundable regardless of whether or not RSI is able to complete and deliver the Game and/or the pledge items.”

However, the success of the Asylum case implied that crowdfunding backers are covered by the Consumer Protection Act.

Two days later, on 1 July, Streetroller receives denials for his initial PayPal refund claims. However, on 12 July the rest of the unclaimed money ($1,660) arrives via PayPal refund. That totals $2,560, so either some of the refunds weren’t documented in Streetroller’s post, or they were rounding up to $3,000.

Whether the Star Citizen Terms of Service (either the first set or the revised set) would actually stand up to serious legal scrutiny, particularly when you get down to what constitutes an “earned” or “unearned” (the language used in the older ToS passage) pledge, is an open question while they remain untested. It’s probable (though can’t be stated with absolute certainty – I am not a lawyer) that legislation like the Consumer Protection Act, if applicable, would take precedence. In this instance though, CIG have opted not to push the matter further by simply agreeing to Streetroller’s refund request.

The story doesn’t quite end there, because on 11 July (one day before his PayPal refunds show up) Streetroller was contacted by an investigator from the LA Department of Consumer and Business Affairs. After an hour long discussion about Star Citizen, Streetroller says he was told to encourage others to file complaints against CIG with the DCBA.

Why are these idiots donating so much to these projects? They aren't investors. They're getting nothing back other than the project.

The whole project seems stupid because there's no cap to the funds raised. They should have said first 20-30 mil goes to making game 1. After that, it's Expansions. After that, it's sequels. This keeps the project relatively small, and focused. There's no way that a 117 million dollar game will live up to expectations.

Right now it's the 6th most expensive video game EVER.

They were absolutely not involved and never have been. Derek Smart was refunded for the EXACT same reason and someone filed a FOIA request for his claims of having an FTC involvement going and it was found there never was any FTC involvement.

Anyone who starts acting like this gets their money back and told to fuck off. These people don't want refunds, they want to hold onto their pledges and make threats over it.

And CIG said refunds will still be handled on a case by case basis but not open to everyone.

Just saying DayZ has no objective at all, but as far as sandbox MMOs go it's also extremely gimped if it was ever having a chance in the first place. Star Citizen has basically more or less the same with the ability to roam in a massive area and gank people, but also has persistence so when you quit the server and join a different one you keep your progress/status.

SS13 is an example of something that's also quasi-game but I tried to phrase it as such it's superior to DayZ. Honestly, if I had time and know how, I'd be coding for SS13 because it's *THIS* fucking close to being a proper game with a proper game loop in my opinion, but it has too many gaping holes that let RPfags and validhunters destroy the round progression then either autismfort or wipe the slate clean too often to keep anyone interested.

Kickstarter rewards people who can weave great promises, not people who deliver. The coolest kooler story is pretty apt. Hype up a cooler as the COOLEST thing ever that has all this shit. In the real world it's heavy and impractical.

Also rewards people who have tangential connections to games to profit on them. Inafune was only an artist and producer for the series. His involvement meant making promotional art, making some character designs, and then sitting in meetings, and okaying projects. Drawing and corporate shit. He never made the games, and was no "visionary". But because he was "the mega man guy" everyone thought he was, and gave him millions.

CIG has made it clear since the beginning that SC will utilize sharding to work around limitations with the game engine, meaning there may be a 20-60 person cap per instance A, then the game creates new instance B and places the spillover into it. It makes it near impossible to zerg rush by numbers as a result, which immediately dampens the effectiveness of Goon strats.

Another major factor is that with EVE, they can refer people / new accounts for 21 days, obtain an item worth a month of ingame time that can be resold on the game market for major money, and be part of a group that was so large and rich, they could finance alts and members for ages (until CCP changed the value of the stuff the Goons stockpiled, making it worthless, since the system revised it based on availablity within the game)

Meanwhile, SC is sold at a minimum of $45 or so now, I think, to be able to play the online portion.

EVE will forever be their swansong, since the only other game they can really shine in would be Darkfall Rebirth, but I don't see them jumping on a literal noname game just to do what Goons always do.

The backgrounds in the games are 3D renderings. That is, someone spent the time to make a 3D world. Then they took snap shots of it to create the backgrounds at different angles. Other backgrounds are 2D paintings.

The game is big budget and a huge change to the 2D games before it.

I feel like the shard system will be easily exploited. I imagine an organized group can beat anyone by bringing in 15-20 allies at the start of a fight thus restricting their enemy to 5-10 ships. Even if the shards allow for 60 people you can still use the same strategy just scaled up.

I don't know much about American law (I'm assuming this is under american law since the guy filled the complaint in L.A., even though the Company in question operates in the UK) but in my home country, the Consumer Protection Laws preceed any "No Refunds" bullshit. I think capitals in SC are meant to be more like Titans in EVE, and other big ships in space fiction; only meant to see the light of day during major operations, not casual joyrides.

Then there was some rambling about how a full capital ship will be able to defend against multiple ships due to player skill and stuff like that, and doesn't seem like anyone really gave it much thought on the dev side before they threw ships for sale with offers of a future gameplay.

This guy is pretty much spreading misinfo, as it was mentioned a few times in a row to make sure everyone heard during 10 for the Chairman: It's ship based, ships are WAY more complex and resource heavy compared to players. Player count is totally fine except for needing to distribute lots of complex physically simulated ships and objects to more people.
And that is getting remedied because servers have no concept of LoD when it comes to physics for now, that rework will be coming in 2.7 so you don't simulate loose debris on the other side of a star system.

They have a ship that's intended to crew 300, and they reinvented the octree method of instance management (used in just about every game including CoD for management of a map) to have arbitrary distances, so servers will be able to run a lot more and focus on X number of resource hogging objects as single instances/entities instead of number of players in a fixed space. They already worked the engine out so everything inside a ship no matter how big counts as it's own instance, and people are transitioning in/out of them seamlessly right now.

Instances are as simple as invisible boxes you literally walk into, sharding will have no solid barriers to entry or gameplay as it is at the moment.

The thing is that people forget that multiplatform development costs money itself. Spending a shit load of money to developer N9 for every platform under the sun sure drained a lot of those kickstarter funds.

And it was an absolute jew move, no doubt. Inafune should have used his strengths better and develop the game as a console debut for the PS4 (I'm saying that because it has the strongest market) and THEN develop the game for other consoles like the Xbox and the PC.

Make N9 as good as possible, get good reviews and then have the luxury of porting it where ever you want.

No, it'll be down to the resources. So I imagine capital ships will take more space than constellations.
However if this is all worked out right, it should be impossible to see instances between two different fleets. From what I understand, the method was effectively from the start going to be so that torpedoes and similar long range weapons will only be considered for visual range of ships, as everything else won't have the range e.g. lasers, so instances would work around that.

I don't know how they're going to handle e.g. a capital ship being wedged between two instances, but from what I can tell it will largely be down to "player is port side/player is starboard/player is in the ship"
