Yes and no. It depends on how they use it. If they're using his speech they need to get permission, but if they're using it like abvove it's new content. It's mostly because he's speeches are copyrighted.
The emblem of the president is actually harder to use then the image of the man.

They can but unless there's a point to it it doesn't really serve any function that a fictional president couldn't easily fill
Age is also a factor, like in Days of Future Past, it was fine to have Nixon in the movie, even though he didn't do anything, because it acts to pull you into the movie and the era it's set in
Putting a recent president like Obama in a movie is usually in poor taste
