The two biggest problems I have with the trilogy overall were that, as you said, Batman's retirement between the second and third film, and Batman compromising his ethics in Dark Knight.
Lucius says the radar thing is unethical, Bruce agrees and destroys it at the end. But if Batman is willing to compromise his ethics in only the second film, why wouldn't he do it again in the third one? Thematically this plot element would only work in the final installment. This is a large reason, other than Heath Ledger, why the trilogy peaked in the middle
