The doctor was the most responsible for the death (apart from the accused) because he cleared Santiago for duty and never did anything.

The charges were murder, conspiracy to commit and conduct unbecoming. In the course of the trial I would say without Jessup's confession the decision was appropriate. He wasn't arrested at the end on charge of murder or anything like it, just violating the memo against code reds.

I don't think it was stated in the movie, but I like to think the doctor was either coerced into staying quiet because of Jessup, or was just covering his own ass, which is a failing that also should fall under Jessup since the doctor presumably was aware of code reds going on and this culture influenced his medical treatments.

Also see Ross's speech about being impartial and representing the US gov. I don't think he actually KNEW of a conspiracy, it was more like he probably thought there was one and it didn't matter legally to the case
