Kipling died in 1936, so copyright expired in 2006. It's pretty common for two studios to make more or less the same thing at the same time (Volcano/Dante's Peak, Skyline/Battle LA, Olympus Has Fallen/White House Down, Armageddon/Deep Impact, The Prestige/The Illusionist). Hollywood's a relatively small place, various people are probably all pitching the same idea at the same time.
